Amount of pension provision for employees of the Ministry of Internal Affairs (calculation formula)

The determination of length of service for a police officer is regulated by Article 14 of the Law of the Russian Federation of February 12, 1993 N 4468-1.

When calculating this type of pension the following factors are taken into account:

  • salary amount;
  • salary amount for a special rank;
  • length of service in the Ministry of Internal Affairs or mixed work experience;
  • long service bonus.

The formula for calculating the pension of an employee of internal affairs bodies with 20 years of service and with a mixed service of 25 years in 2019 is as follows:

RPO = 1/2 × (OD + OSZ + NVL) × 72.23%,

  • RPO- the amount of pension provision;
  • OD- salary according to position;
  • NEO - salary for a special rank;
  • NVL- bonus for length of service;
  • OD + NOS + NVL- the amount of monetary allowance of a military personnel (DD).

The amount of pension provision may increase for each year of service over 20 years - 3% of the specified DD, but not more than 85% in total, and with mixed service for each year over 25 years - 1% of the DD amount.

Calculation of old-age insurance pension for a pensioner of the Ministry of Internal Affairs in accordance with Article 15 of Federal Law No. 400 of December 28, 2013 “About insurance pensions” produced according to the following formula:

SP = IPK × SPK,

  • JV- old age insurance pension;
  • IPC- the value of the individual pension coefficient;
  • SPK- the cost of one PC on the day of pension.

Increase (indexation) of Ministry of Internal Affairs pensions in 2019 in Russia for those who are already retired

Since the size of pensions for police officers depends on the size of their salary, an increase in the amount of pension benefits becomes possible in the event of an increase, which has not been carried out for several years. The indexation planned for October 2016 was not carried out due to lack of financial resources.

The reason for this situation is the difficult economic situation in our country, which negatively affects the filling of the Federal budget, from which the Ministry of Internal Affairs is financed.

At the end of October 2016, the Russian government introduced a bill to the State Duma to extend until January 1, 2018 the “freeze” of pay for federal employees, military personnel and employees of other law enforcement agencies, including the Ministry of Internal Affairs.

However in 2018 military pensions will increase by increasing the amount of money allowance by 4%. At the same time, in 2018 it will be established at 72.23%.

Must be carried out annually:

  • February 1 on the inflation rate;
  • April 1, based on the capabilities of the Pension Fund.

As for the second labor pension, it has been increased by 3.7% since January 1, 2018, which is ahead of schedule and higher than inflation in the previous year.

Will there be a one-time payment of 5,000 rubles to pensioners of the Ministry of Internal Affairs in 2019?

In the original version of the bill on the payment of one-time compensation, there was no mention of pensioners of the Ministry of Internal Affairs, whose payments are regulated by a separate law of the Russian Federation dated February 12, 1993 No. 4468-1, and only recipients through the Pension Fund were mentioned.

However, after a meeting held on November 8, 2016 in the Security Council of the Russian Federation, the President issued an order to make appropriate amendments to the plan so that pensioners of law enforcement agencies, including the Ministry of Internal Affairs, would receive the plan for January 2017.

If a pensioner of the Ministry of Internal Affairs works, will he pay a second pension?

Many pensioners of the Ministry of Internal Affairs, after retirement, continue their work in civilian structures and, upon reaching conditions specified by law, receive the right to receive an old-age insurance pension simultaneously with the departmental one already assigned to them through the Ministry of Internal Affairs.

Payment of pension benefits assigned to employees of the Ministry of Internal Affairs in accordance with Article 57 of the Law of the Russian Federation of February 12, 1993 No. 4468-1 is made to their recipients, regardless of work activity.

If a pensioner of the internal affairs bodies, receiving two pensions, continues to work, then pension payments, both through the Ministry of Internal Affairs, continue to be made in full, but in accordance with Article 26.1 of Federal Law No. 385-FZ, indexation of payments through the line The Pension Fund will be suspended for the period the recipient of the pension carries out work activities.

It is no secret that older people are one of the most vulnerable groups of the population in Russia. Often they have no other financial support other than pension payments: they are used to pay for bank loans, housing and communal services, large purchases and the whole range of everyday expenses. That is why it is so important to receive your pension on time - a delay in payment can seriously complicate the life of an elderly person.

Unfortunately, no one is immune from pension delays today: against the backdrop of the economic crisis, interruptions in payments occur even in the most prosperous areas. That is why it is important to know about the reasons for untimely accruals, as well as about the algorithm of actions - where should a pensioner whose pension was not credited to the plastic card on time turn to.

Reasons for delay in pension payment

Let's start with the pension payment schedule. The specific day on which accrual should occur depends on your place of residence - all necessary data in this regard must be provided by the local representative office of the Pension Fund (). Before you start worrying about pension delays and calling the relevant authorities, remember: payments may fall on a non-working day or public holiday. In this case, you will be required to accrue your pension earlier than this period.

If payments were not accrued on the due date, it is time to ask the question: why are pensions being delayed? There could be a lot of reasons for this. Sometimes they are a consequence of a difficult financial and economic situation, more often they appear due to the fault of the human factor. Let's name a few of the most common reasons why there is a delay in accrual:

  • The Pension Fund did not have the necessary amount of funds to pay pensions. Unfortunately, a number of Russian regions have had to deal with this in recent years.
  • A delay may occur at the stage of transferring funds - in this case, the fault lies with the financial institution. The funds will be transferred with a delay of one to two days.
  • The documents submitted to the Pension Fund of the Russian Federation were incorrectly completed. This is especially true for those citizens who receive a pension for the first time.
  • The reason for the delay is sometimes the lengthy process of approval and execution of documentation between the Pension Fund and the financial institution. In this situation, responsibility may lie with the pensioner who has just retired: if the necessary papers were not submitted to the authorities in a timely manner, a delay in pension is very likely.
  • During the activation of the plastic for which the accrual takes place, errors were made. You should contact the financial institution with this request and find out why it is not working.

If one of the above reasons applies to your case, you can begin to act. There is no need to sound the alarm too early: given a number of technical issues, as well as the uncoordinated work of Russian social services, you should contact the relevant authorities 5-7 days from the date of non-payment of the pension, and not earlier. We propose to act according to the simplest scheme:

  • First, get a document from the financial institution stating that the pension was not accrued on the due date. For example, if there was a delay in the pension on the card, immediately visit one of the branches of the institution: bank representatives will be required to provide a report on the transactions made on your account.
  • Also request from the financial institution documentary evidence that the pension was not credited to the card account.
  • Having received the necessary papers at the bank branch, contact the next authority - the Pension Fund.

Appealing and protecting your rights in court

So, if you did not receive your pension on time and decided to contact your financial institution or the Pension Fund for clarification, wait for an answer: they must tell you about the circumstances that caused the non-payment, and also indicate a new period after which the pension will be transferred. As a rule, this measure is enough to eliminate the problem. If no clarification is provided to the request within the prescribed period, you have the right to file a complaint:

  • to the Pension Fund of Russia;
  • to a financial institution;
  • to the prosecutor's office.

It must be considered within a month from the date of submission to each of the indicated authorities. There is no single template for a complaint: like any claim that is documented, the complaint is written in free form. However, there are a number of requirements for the content of the document. In the document, the individual indicates:

  • the authority to which the complaint is filed;
  • personal data (full name, address, telephone number);
  • content of the complaint (it is necessary to describe the situation);
  • requirements for the body to which the complaint is filed, with references to the current legislation of the Russian Federation;
  • date of writing the complaint;
  • list of applications.

If filing a complaint has no effect, you can defend your rights in court (at the location of the Pension Fund branch). To competently draft a claim, we recommend that you seek advice from a lawyer. If this is not possible, you can write an application to the court yourself - finding the appropriate sample on the Internet will not be difficult.

An employee of the Ministry of Internal Affairs cannot be classified either as a military person or as a civilian. Therefore, a completely logical question arises: how is the pension of employees of the Ministry of Internal Affairs determined? These are the questions that will be discussed in this article.

The time when an employee can retire, as well as the payment procedure, is strictly regulated by RF Law No. 2268−1 of 02/12/93 (as amended on 11/04/11).

How to calculate the pension of an employee of the Ministry of Internal Affairs using the formula

  • Class qualifications;
  • Salary amount;
  • Military rank;
  • Seniority;
  • Percentage of bonus for length of service.

The salary amount must be added with all allowances and multiplied by the percentage established by law, which depends on the amount of salary. Then, the entire amount is multiplied by a coefficient that is set by each region depending on its budget.

For example: an employee of the Ministry of Internal Affairs is going to retire, his experience is 23 years , A salary amount - 9 thousand rubles. The amount of his salary by rank - 12 thousand rubles. Percent surcharges - 25%, which is 3 thousand rubles . The pension will be calculated as follows: the total amount of monetary allowance is calculated, it is 24 thousand rubles, multiplied by the percentage of his monetary allowance (first 0.54, then 0.56). The monthly payment amount is 7257.6 rubles.

Pension payment deadline for the Ministry of Internal Affairs

The first payment, according to the appendix to the order of the Ministry of Internal Affairs of the Russian Federation No. 418 dated 05/27/05 (as amended on 04/04/11), will be made to a current account or bank card on the 6th month after dismissal from the authorities. This is due to the fact that upon retirement, an employee is required to pay 5 salaries.

Monthly payments are made, depending on the region of residence, from the 15th to the 25th of each month.

Recalculation is made from the 1st day of the month following the one in which changes in the amount of payment occurred, unless otherwise provided by law. All changes must be made to the pension file, indicating the date, amount and reason for the change. If the amount is increased upward, all additional payments will be transferred to the recipient's account along with the next payment.

Pension indexation is carried out because real incomes are falling and prices are rising. This measure is a kind of support from the state for its citizens. As a rule, pensions are indexed in stages several times a year. A clear interest rate is not prescribed in laws; it is determined when the country’s budget plan is formed.

Increasing pensions for employees of the Ministry of Internal Affairs in 2016-2017

The reform of the Ministry of Internal Affairs has changed the procedure for retirement; now it can be achieved after working for at least 25 years.

In 2016, the state, unfortunately, was unable to index pensions to the full planned extent. It is still unknown at this point in time whether pensions for pensioners of the Ministry of Internal Affairs will be recalculated in 2017. As in the past, a gradual increase in the amount of payments is planned, but whether it will be carried out remains a question.

Pension of the Ministry of Internal Affairs according to length of service

An analogue of the insurance part of the pension of an ordinary resident of the Russian Federation is a long-service pension. If he reaches the age limit for serving in the Ministry of Internal Affairs or is dismissed due to staff reduction, the right to a pension will be retained upon fulfillment certain conditions:

  1. Work experience of at least 25 years;
  2. At least 12.5 years out of 25 must be spent working in the Ministry of Internal Affairs.

To be able to receive the main type of pension, the only necessary condition is length of service. Age does not play a special role in this case.

Disability pension in the Ministry of Internal Affairs

This type of payment is guaranteed if the disability was received during the period of service or no more than 3 months after dismissal. If the degree of disability was received later, it must relate to one of following criteria:

  • Mutilation;
  • Wound;
  • Disease;
  • Contusion.

The amount to be paid will directly depend on the result of passing the medical commission. She will give her opinion on the assigned disability group.

There are a number of citizens who can receive additional payments:

  1. A person receiving a pension from an employee of the Ministry of Internal Affairs if his age is more than 80 years;
  2. A person who worked in the Ministry of Internal Affairs and receives pension payments and is in the care of disabled family members;
  3. A person who worked in the Ministry of Internal Affairs and retired, who is a WWII veteran.

Pension for widows and relatives of employees of the Ministry of Internal Affairs

It is accrued only to the legal relatives of the deceased if he died during the period of service. This rule will apply after the death or death of the breadwinner, if no more than 3 months have passed since his dismissal or retirement. Receiving this payment is also possible if the breadwinner died later than the deadline established by law due to injury or illness received while working in the Ministry of Internal Affairs.
